Law Enforcement Guidelines

1. Introduction

nextduo ("nextduo," "we," "us," or "our") is committed to cooperating with law enforcement agencies in accordance with applicable law. This page describes how law enforcement officials and government authorities may submit requests for user information, content preservation, or other legal process to nextduo.

nextduo is operated by KD Studios. Our platform is an 18+ social and gaming-oriented connection service. We take the safety of our users and the integrity of our platform seriously and will respond to valid legal requests in accordance with the procedures outlined below.

2. Designated Point of Contact

All law enforcement requests must be submitted in writing to our dedicated legal contact:

  • Email: legal@nextduo.app
  • Subject line: Law Enforcement Request — [Agency Name] — [Case/Reference Number]

Requests submitted through other channels (e.g., general support email or social media) cannot be processed and will be directed to the above contact.

3. Types of Requests We Accept

We accept the following categories of legally valid requests:

  • Subpoenas — For basic subscriber information and account metadata.
  • Court Orders — For more detailed transactional or usage records, where the order demonstrates specific and articulable facts.
  • Search Warrants — For content data, including messages, photos, or detailed activity logs, where issued by a court of competent jurisdiction upon a showing of probable cause.
  • Emergency Disclosure Requests — In situations involving a genuine, imminent threat to life or serious bodily harm (see Section 7).
  • Mutual Legal Assistance Treaty (MLAT) Requests — For international law enforcement requests routed through appropriate treaty channels.

4. Information We May Be Able to Provide

Subject to valid legal process, nextduo may be able to provide the following categories of information:

  • Basic Account Information: Username, email address, phone number (if provided), account creation date, and last login timestamp.
  • Device & Connection Data: IP addresses associated with logins, device type, and operating system (to the extent logged and retained).
  • Profile Information: Display name, biography, profile photos, and gaming preferences as entered by the user.
  • Transaction Records: Subscription and payment history (note: full payment card data is processed by Stripe and is not accessible to nextduo).
  • Communication Metadata: Records of when messages were sent or received (subject to applicable law and the type of legal process presented).
  • Message Content: Only in response to a valid search warrant or equivalent process.

We do not store full payment card numbers. Payment processing is handled by Stripe, Inc. Law enforcement seeking financial transaction records beyond what nextduo holds should direct appropriate legal process to Stripe.

5. Requirements for a Valid Request

To be processed, all requests must include:

  • The full legal name and official contact details of the requesting agency and officer.
  • A case number or official reference identifier.
  • A clear description of the user account(s) being requested (username, email, or user ID).
  • The specific categories of data requested and the time range.
  • The legal basis for the request (e.g., statute, court order number, warrant number).
  • A copy of the relevant legal instrument (subpoena, court order, or warrant) on official letterhead and/or bearing an official seal or signature.
  • The name, address, and telephone number of the law enforcement officer to whom we should address the response.

Requests that do not include the above information may be returned without action pending receipt of the missing details.

6. International Law Enforcement Requests

nextduo will only disclose user data to foreign law enforcement authorities via Mutual Legal Assistance Treaties (MLATs) or equivalent formal channels unless an emergency disclosure applies (see Section 7). Requests submitted directly by foreign law enforcement without going through an MLAT or equivalent process will not be processed.

7. Emergency Disclosure Requests

nextduo may voluntarily disclose user information to law enforcement — without legal process — if we have a good-faith belief that doing so is necessary to prevent imminent death or serious bodily harm to any person, as permitted under applicable law (e.g., 18 U.S.C. § 2702(b)(8) in the United States).

Emergency requests must:

  • Be sent to legal@nextduo.app with the subject line EMERGENCY DISCLOSURE REQUEST.
  • Include the officer's full name, badge number, agency, and a direct callback phone number.
  • Clearly describe the nature of the emergency, the imminent threat, and why nextduo data is needed.
  • Identify the specific account(s) involved.

We will review emergency requests as promptly as possible. Abuse of the emergency disclosure process is a serious matter and may be reported to relevant oversight authorities.

8. Data Preservation Requests

Law enforcement may request that nextduo preserve specific user account data while formal legal process is obtained. nextduo will endeavor to preserve relevant data for 90 days upon receipt of a valid preservation request. Preservation requests may be renewed for one additional 90-day period. Following the preservation period, data will be subject to our standard retention and deletion policies unless formal legal process has been served.

A preservation request does not constitute legal process and does not authorize nextduo to disclose the preserved data. Disclosure requires a separate, valid legal instrument.

9. User Notification Policy

nextduo's policy is to notify the affected user of a law enforcement request for their data prior to disclosure, unless we are prohibited from doing so by the terms of the legal process (e.g., a court-issued non-disclosure order or gag order), or where notification would create a risk of harm (e.g., in cases of imminent threat to life or child exploitation investigations).

If you are a law enforcement officer seeking to restrict user notification, please include a specific non-disclosure order or clearly state the legal basis for prohibiting notification within your request.

10. Cost Reimbursement

nextduo reserves the right to seek reimbursement for costs associated with responding to law enforcement requests, as permitted by applicable law (e.g., 18 U.S.C. § 2706). We will notify the requesting agency of any applicable fees prior to incurring them.

11. Child Safety & CSAM Reporting

nextduo has a zero-tolerance policy for child sexual abuse material (CSAM) or any content that exploits or endangers minors. We report any discovered CSAM to the National Center for Missing & Exploited Children (NCMEC) via CyberTipline as required by 18 U.S.C. § 2258A.

Law enforcement agencies investigating child exploitation matters are encouraged to contact us at legal@nextduo.app and may use the emergency disclosure procedure outlined in Section 7 where time is critical.

12. Requests We Will Not Honor

nextduo will not comply with requests that:

  • Lack valid legal process or do not meet the requirements in Section 5.
  • Violate users' constitutional rights, including First and Fourth Amendment protections.
  • Are overbroad, unduly burdensome, or seek data that nextduo does not possess.
  • Are from foreign law enforcement not routed through proper MLAT channels (except emergencies).
  • Are designed to suppress free speech, target individuals based on protected characteristics, or otherwise appear pretextual.

nextduo reserves the right to seek to modify or quash any legal process it believes to be improper through appropriate legal channels.
